*出境前获批AP (Advance Parole)，且持AP回美
*出境前是H或L身份，且以H或L签证回美 ，保持雇主不变 ；**这里尤其要注意，如果没有拿到AP就离开美国，即使有H1b签证，如果碰上裁员，即使立刻找到下家并办了H1b，还是不满足“同雇主返美”的要求，所以仍然视作放弃485**所以最最最最安全的方法应该是，出境前就有有效AP，这样能用H1b返回当然可以用H1b，不能用的话也可以拿AP返回
